Convicted murderer writes to Journal from prison

NICK Rose — the man convicted of the murder of Ilfracombe teenager Charlotte Pinkney — has continued to protest his innocence in a direct letter from his prison cell to the

Journal

.

And he blamed the "inexperience" of investigating police for his current situation, serving 20 years at the maximum security Wakefield Prison.

Following huge web interest in the

Journal's

last story about Rose's final appeal, the man at the heart of one of North Devon's most debated cases put pen to paper and wrote to the newspaper.

Rose's final appeal was on the brink of collapsing last month, after the Criminal Cases Review Commission (CCRC) — set up to investigate possible miscarriages of justice — provisionally announced there were insufficient grounds for a new appeal.

But his mother Kay Rose said lawyers were still on the case and she remained "optimistic".

Police continued to appeal to Rose to admit culpability for the crime to give the Pinkney family some closure, but in his letter, Rose said: "The case against me is full of circumstantial evidence that was put together by a police force that had limited (if that) experience in murder cases.

"For God's sake, they turned it from a missing person to a murder investigation within three days and brought me in for questioning on the third day and that was with none of their circumstantial evidence and from that moment onwards they only had me in their sights."

And he launched a fiery attack on Detective Inspector Dave Atkinson, who was quoted as saying Rose could make a difference to his years behind bars if he confessed his guilt.

Rose wrote: "How dare this man offer me a lower security prison and make a difference to my time, this for me to admit to a crime I'm innocent of (when did he become God?).

"I would happily spend the rest of my living life in a dark hole knowing I'm innocent and if I'm guilty like he says why would he want to help me."

And it seems, he has no intention of giving up on appealing his innocence.

"There are many other means of lodging new appeals because in such of a case like mine fresh and new evidence is likely and then it would be back to the CCRC. I think it's clear to everyone there are people in Ilfracombe that know more than they said, maybe they might actually find they have a conscience or a heart."

Addressing the police he wrote: "...we might highlight one of your many mistakes because we know what they are we just have to prove them..."

    “the passing of time only adds weight to those misguided individuals, who help & encourage the murderer that is nicholas rose, to continue to protest is innocense,

    he killed charlotte pinkney, of that there is no doubt,
    lock him up for good & throw away the key, untill he puts the young girls family out of their continuing misery, & tells the authorities where the young girls remains can be found!”

    “i am very dissapointed with NDJ publishing letters written from a convicted murderer. the way he goes on about drawing lines on what people can say about him and his family. this comes from a coward who refuses to take responsabiliy for his actions.     Dear Members,

    Well I thought I¿d let you all know how I¿m getting on, as it¿s been a few weeks since I last wrote to you all & a lot has gone on since then, mainly being all the stuff in the North Devon Journal & the comments that were made regarding both stories, (good & bad comments), it¿s funny how all the negative comments were made by people using fake names & I bet that Dave Smith is many of them, talking his rubbish, I don¿t mind people having their opinions even if they are against me, it¿s their right, but I draw the line at bringing up what happened to my sister many years ago, and it¿s f****** sick, it¿s no wonder they don¿t put their real names with their comments & I suppose changing the subject away from my case is their way of chucking dirt, my sister means the world to me & is the strongest girl I know, I¿m very lucky to have her as my sister & I would do anything for her, I know the evil comments that were made won¿t get her down, because she is strong & if it did bother her I¿d make it my goal to find out who the fake names were, it¿s really low bringing it up & shame on them who did!
    Another topic was people talking about a lie detector test to be done on me & I¿m more than willing to take one & I¿ve always said that when I clear my name I¿d take one, prisons will not allow them & many innocent people are fighting to take them to clear their name, but until the british justice system recognises them as evidence, I can¿t see them being allowed. There was a new type of test that measured all parts of your body, it came about a year ago, that wanted to test people who maintain their innocence, but after one test in Scotland that a man passed, they didn¿t go ahead with it. People think I should do it to get them on my side & it doesn¿t matter whether I¿ve got a 1,000 supporters or 10,0000 supporters, the appeal will still have the same outcome & I¿m sure there would be another excuse to dis-credit me, that¿s how innocent cases go!
    I wonder if the police witnesses would undergo a lie detector test about their evidence & if so which story would they go with, as some of them changed their versions of events from the police statements to their evidence in court, also ask D.S Atkinson to take one about him coming to see me, because I can assure you he¿s never been anywhere near!!!
    Also I couldn¿t believe the comments about how a judge & jury are 100% full proof, they are just very naïve or has not seen the news in their life, it¿s a problem that is all over the country & not just in Devon, but I suppose it doesn¿t fit in to their pretty little world, but take it from me just around the corner it could be them or one of their loved ones that are accused of a crime they are innocent of & maybe they will be locked away from their loved ones & wake up everyday knowing their future is unclear & having to deal with being innocent in prison, having to live in the same place with the worst of the worst that¿s ever been born, all this is just inside jail, the worst part is missing out on all your loved one¿s special moments in life, I¿ve had to live this life for nearly 6 years & instead of it getting easier it¿s getting harder, but I am very lucky to have all the support & help from my family, friends & supporters, it¿s a great comfort to me, there are many innocent people who don¿t have that support & help, so I consider myself a lucky one!
    A lot of comments were made about this being brought up as a way of hurting the Pinkney family, but they need the truth, just as much as I do, they have been & probably still being lied to by the police, people on the NDJ site were using it as some sort of contest about who¿s hurting the most, which shows what idiot¿s they are, it¿s obvious that the Pinkney family are hurting more, but me & my family have not ”

    “Having first met Nick as a 14 year old boy I was gobsmacked when I was told that he had been convicted of the Murder of Charlotte Pinkney. The Nick I remembered was cheeky, a bit of a jack the lad but capable of murdering someone and disposing of a body where it would never be found, no way.
    I was living away at the time having moved to London some 10 years previously and remember thinking things just did not seem to add up. Charlotte had in fact gone to school with my little brother and it really saddened me to think that she had not been given the chance to see how great life could be but instead her life consisted of taking drugs, hanging around with low life and being treated like crap by a man old enough to be her farther but then Ilfracombe does seem to breed that mentality that there is nothing better out there. I was not around for the first trial but was later in a relationship with Nicks Cousin and so was around to see all the hard work and effort that Nick¿s family put in on a daily basis to clear Nick¿s name. Nicks Family are honest, good and decent people and I know without a shadow of a doubt if they suspected he was not telling the truth they would not be backing him. I also know that having read letters from Nick and spoken with him on the phone that there is no way he is guilty. On several occasions he has made me laugh with his accounts of what he has been doing or asking if I have any fit friends to write to him and I know that if he had murdered Charlotte he would not be able to hide the guilt and remorse he feels.
    I do have a few questions like what are the police now doing with the case now? Have they stopped searching for Charlotte? Also where all of Charlottes so called friends who appear to have conveniently forgotten about her, there are no memorial sights on Face book, Twitter, Bebbo etc and I have never even seen a mention of her name on her Birthdays at Christmas etc.
    I am not talking about her family by the way her family as I am aware that it must hurt them every day and that they do not need to share their grief or memories with anyone, but her friends??? I know 100% if anything happened to one of my best friends and I had been around on the night she went missing I would ensure that I did not stop searching and asking questions until I knew 100% what had happened to them and would make sure that their memory was kept alive. I am positive that there are people in Ilfracombe who know a lot more than they have said so far and I would like to say to you all that if you cared about Charlotte at all and her family then you should speak out I am sure many of you have your own children now and can maybe begin to imagine how Charlottes family feel not knowing what happened to her and the pain Nicks family feel knowing that he has had his life taken away too and his son is having to grow up without a Dad.

    I will keep supporting Nick until the day he is free as he is my Friend and I know he is Innocent.”

    “I belive that Charlotte Pinkney died of an Overdose, caused by the party lifestyle she was involved in, with so many children her age taking drugs and not understanding the effects and destruction class a's can cause, and the increased dangers when mixng with alchol!
    The person who supplied this cocktail of drugs is more than likley to be the person who last seen her alive or more to the point semi conscious due to drugs and alchol intake.”

    “This case really needs to go to a retrial with ALL the evidence presented.

    How anyone can be convicted of a murder when there is no body and when the alleged victim was seen by several reliable witnesses after she was upposed to have been killed is beyond me.

    The so-called 'conclusive evidence' is as flimsy as any thing you could imagine.

    There are two possibilities. Either a murder has been committed and the real villain has got off scott free whilst an innocent man is in prison, or no such crime has even taken place in which case Charlotte may still be alive. If she is alive then there is the possibility that she was abducted or that she even just simply ran away.

    Could she have met with an unfortunate accident elsewhere and be one of those unidentified people we hear of?

    We will never know the real truth until people stop being blinded by a convenient use of a scapegoat. Surely Charlotte's family deserve to know what really happened to her and they will never know that whilst Nick Rose remains imprisoned for a crime he did not commit.”

    “i think silvia has a good point, lots of prisioners protest their innocence even until their death bed, look at the moors murders, wouldn't even tell the mother where they burried her boys body and the secret died with him. Nick roses family are the only thing keeping him going, if he admits it then he will loose them and their support then how would he cope inside? Also i think silvia is right in saying that Charlottes family have been very dignified in what must be very hard for them knowing that they will never see their daughter again and still having no closure. I expect they are trying to move on with their lives and like silvia said if the wrong man is in prision i think they would be the first ones to say something as they want to find her body for closure. I hope this gets laid to rest soon for the pinkney family's sake.”

    “This is the edited version of my comment from last night.

    In answer to Silvia, there are many convicted murderers that serve many years before their innocence is proved!!!
    Nick could have been out by now if he had accepted the manslaughter plea that was offered to him at the trial, but he refused, because he did not do this crime!
    Of course it is our mission to clear Nick's name, as we believe him 100%.
    Yes we have asked ourselves whether we ever thought he was guilty! do you think we would be fighting like this, if we thought he was guilty!!!!
    Do you realise that for over 5 years every spare minute that we have, we have been working on Nick's case, reading all the unused statements/police reports, which is really hard when lots of it has been deleted with permanent marker, and i don't mean their addresses! and you would be very surprised at what we have found! lots of evidence that can be used at a re-trial, and that¿s what we are fighting for!!! When you say APPEALS, don't you mean APPEAL, as there has only been ONE APPEAL!!!!!!!
    It's nice to know that Charlotte's family had access to all the evidence, but i don't think they have seen all the unused, they only heard the evidence at trial and what the police told them!
    We were very naive at the start of this nightmare, and put our faith in our legal team, we found out after the trial that it was the 1st murder our Q.C had led, i know lots of people blame their legal team, they done their best, but there was a lot more things they could have used, but they thought they had enough to prove Nick innocent, due to the numerous sightings of Charlotte, after the time Nick had dropped her off, i don't think these people are liars, they had no reason to lie, they were decent honest people, and everyone knows they are!
    Yes the verdict was a majority of 11/1, but it took them from the 9th feb-17th feb to reach that decision, so hardly an open & shut case!!!!

    As someone has already said on here, that Charlotte was living a dangerous lifestyle, as drugs were a part of her life, as was dangerous people, we know she was threatened by these people on the phone!
    So as to conspiracy theorists, there are lots of things that people don't know concerning this case!
    So maybe Nick was a convenient suspect in more ways than one!!!”

    I just made a comment about her parents as i grew up with bob,and i feel for him,i can also understand that nick roses parents are suffering too

    now listen mr meee,i dont hide behind an alt,if you want to say something say it to my face or at least use your name,i dont understand who my best mate is meant to be,i have lived in spain for the last 10 years,if you are talking about gus o'brian,,dont really know the guy apart from the fact he came it the f'ocsle 20 years ago when i ran that and i served him a few beers

    my mistake was that i just felt sorry for 1 set of parents,in reality both are suffering though in vastly different ways
