Mr Tolley was part of a South West Highways gang repairing a stretch of the dual carriageway at Gornhay at the time of the 11am incident.

A second man, who is also in his forties and from Tiverton, also suffered serious injuries in the crash. He was airlifted to the Royal Devon & Exeter Hospital but has since been discharged and is recovering at home.

A 22-year-old man, also from Tiverton, was also treated for injuries at the scene and was described as “walking wounded” by police while a fourth man was treated for shock.

Following the crash, the 43-year-old van driver, who is from the Saltash area, was arrested on suspicion of dangerous driving and was taken to Heavitree Road Police Station in Exeter. He has since been released on bail until May 20.

The A361 was closed in both directions at Bolham roundabout for around six hours following the crash to allow the scene to be cleared and for investigations into the circumstances surrounding the crash to be carried out.

Police and the Health and Safety Executive are continuing their investigation into the collision.

Officers have renewed their appeal for witnesses to the collision and would particularly like to speak to those who saw the Iveco van in the area at the time or how and where the men were working in the road.

Witnesses are urged to contact MPC Chris Wright at Exeter Serious Collisions Investigation Unit by calling 101, quoting log number 208 29/01/13.
