David Barnes, for the prosecution, said police were called to Barum takeaway, in Queen Street, in the early hours of October 5 after reports a man was refusing to leave the shop.

When they arrived they found Collins asleep on the pavement with a doorman on top of him. When they were unable to revive him and send him home they decided to arrest him.
